OVERVIEW

Welcome to Geeky Medics. In these Terms, “Geeky Medics”, “we”, “us” and “our” means Geeky Medics LTD, a company registered in England with company number 09523980 and registered office at Lytchett House, 13 Freeland Park, Wareham Road, Poole, Dorset, BH16 6FA.

We operate this website and online store, including all related information, content, features, tools, products and services made available through it, in order to provide you with a shopping experience and related services. Our store is hosted by Shopify, which enables us to provide the store platform to you.

These terms and conditions, together with any other policies referred to in them, including our Privacy Policy and Refund Policy, set out the terms on which you may use our website and buy products from us.

By using our website or placing an order, you agree to these Terms. If you do not agree, you must not use our website.

Nothing in these Terms affects your statutory rights as a consumer.

1. ACCESS AND ACCOUNT

To place an order through our website, you must be at least 18 years old and legally capable of entering into binding contracts.

You agree that any information you provide to us is accurate, current and complete, and that you will keep it updated if it changes.

If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. We may suspend or terminate your account if we reasonably believe there has been misuse of the website or a breach of these Terms.

2. OUR PRODUCTS

We take reasonable care to ensure that product descriptions, images and pricing are accurate. However:

a. images are for illustrative purposes only
b. colours and appearance may vary depending on your device and settings
c. packaging may vary from that shown on the website

Nothing in this section limits your statutory rights where goods are not as described, not of satisfactory quality, or not fit for purpose.

We may update, withdraw or discontinue products at any time.

3. ORDERS AND CONTRACT FORMATION

When you place an order, you are making an offer to buy the relevant product or products.

After you place an order, you will receive an acknowledgement email. This does not mean your order has been accepted.

A contract between you and us is formed only when we send you an email confirming that your order has been accepted and, for physical goods, dispatched, or for digital products, when we confirm that access will be provided.

We may refuse or cancel an order before acceptance, for example if:
a. a product is unavailable
b. there has been a pricing or description error
c. we suspect fraud or misuse
d. there are unexpected limits on delivery to your address

If we cancel an order after payment has been taken, we will refund the amount paid as soon as reasonably possible.

4. PRICE, VAT AND PAYMENT

The price of products will be the price shown on the checkout page when you place your order.

Prices are shown in GBP and include VAT unless otherwise stated. Delivery charges and any other clearly disclosed charges will be shown at checkout before you place your order.

If VAT is chargeable, it will be charged at the applicable rate.

You must provide valid and up-to-date payment information. By placing an order, you confirm that you are authorised to use the chosen payment method.

We reserve the right to correct obvious pricing errors. If there is a pricing error affecting your order, we will contact you and give you the option to proceed at the correct price or cancel.

5. DELIVERY

We will deliver physical goods to the delivery address you provide during checkout.

Any delivery dates or times are estimates only unless we have expressly agreed otherwise in writing.

If our supply of products is delayed by an event outside our reasonable control, we will try to contact you as soon as possible.

For consumer orders, goods remain our responsibility until they are delivered into the physical possession of you or a person identified by you to take possession of them, unless you arranged your own carrier and that carrier was not one of the delivery options offered by us.

If no one is available at your address and the goods cannot be posted through your letterbox, the carrier may leave instructions for re-delivery or collection.

6. DIGITAL PRODUCTS AND ACCESS

If we supply digital content, online access or downloadable products, we will make them available as described on the relevant product page.

You are responsible for ensuring that your device and internet connection meet any minimum technical requirements we tell you about before purchase.

Where digital content is supplied immediately and you expressly agree that supply should begin during the 14 day cancellation period, and acknowledge that you will lose your right to cancel once supply begins, you will lose your right to cancel from the point supply begins.

Nothing in this section affects your statutory rights if digital content is faulty, not as described or does not conform to contract.

7. YOUR RIGHT TO CANCEL

If you are a consumer buying online, you usually have the right to cancel your contract within 14 days without giving any reason.

For goods, the cancellation period expires 14 days after the day on which you, or a person nominated by you, receives the goods.

For services, the cancellation period expires 14 days after the day the contract is entered into.

For digital content not supplied on a tangible medium, the cancellation period expires 14 days after the day the contract is entered into, unless you asked us to start supply during that period and acknowledged that you would lose your cancellation right once supply begins.

To exercise the right to cancel, you must inform us of your decision by a clear statement, for example by email to support@geekymedics.com. 

If you cancel a contract for goods, you must send the goods back to us within 14 days of telling us you wish to cancel, unless we state that we will collect them.

We will make any refund due within 14 days after:
a. the day we receive the goods back, or
b. if earlier, the day you provide evidence that you have sent the goods back, or
c. where no goods were supplied, the day we are informed of your decision to cancel

We will refund the price paid for the product, but we may make deductions as permitted by law, including for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

This cancellation right does not apply where an exception under applicable law applies, including certain sealed goods once unsealed for health protection or hygiene reasons, personalised items, and digital content once supply has begun with your prior express consent and acknowledgement.

Your statutory rights in relation to faulty, misdescribed or non-conforming goods or digital content are separate from, and in addition to, the cancellation rights above.

9. INTELLECTUAL PROPERTY

All intellectual property rights in our website, content, branding, text, graphics, images, videos, downloads and product materials are owned by or licensed to Geeky Medics.

You may use the website only for your own lawful personal use and, where applicable, to purchase products from us. You must not copy, reproduce, distribute, modify, scrape, republish, transmit, display, create derivative works from, or otherwise exploit any part of our website or content except as permitted by law or with our prior written consent.

“Geeky Medics” and our logos, product names and branding are our trade marks or are used under licence. You must not use them without our prior written permission.

10. OPTIONAL TOOLS AND THIRD-PARTY SERVICES

We may provide access to tools, integrations or services offered by third parties. We do not control those third-party services and are not responsible for them.

Your use of any third-party tools or services is subject to that third party’s own terms and policies.

11. THIRD-PARTY LINKS

Our website may contain links to websites or resources operated by third parties. These links are provided for convenience only. We do not control and are not responsible for the content, availability or privacy practices of third-party sites.

12. RELATIONSHIP WITH SHOPIFY

Geeky Medics is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Geeky Medics. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Geeky Medics, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Geeky Medics.

13. PRIVACY

Any personal data we collect and process is handled in accordance with our Privacy Policy.

Because our store is hosted by Shopify, Shopify will also process personal data to provide and support the store platform. Further information is available in Shopify’s privacy information.

14. REVIEWS AND FEEDBACK

If you submit a review, comment, suggestion or other feedback to us, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish and display that content for the purpose of operating, improving and promoting our business and products.

You confirm that:
a. your feedback is your own or you have the right to provide it
b. it does not infringe anyone else’s rights
c. it is not unlawful, defamatory, misleading, abusive or obscene

We may remove reviews or feedback that we reasonably believe breach these Terms or applicable law.

Nothing in this section prevents you from retaining ownership of your content.

15. WEBSITE USE RESTRICTIONS

You must not use our website:
a. in any way that breaches applicable law or regulations
b. to commit fraud
c. to transmit malware or harmful code
d. to interfere with the operation or security of the website
e. to scrape, harvest or extract data from the website without our written consent
f. to use automated means, bots or agents to access the website in a way that harms the website, bypasses restrictions, or imposes unreasonable load
g. to infringe our rights or the rights of others

We may suspend or block access if we reasonably believe these Terms have been breached.

16. AGENTS

This section applies if you use software, bots, scripts, agents or other automated tools to access or interact with our website.

We may limit or block automated access to our website, especially where it bypasses security, ignores technical controls, impersonates a human user, or interferes with the operation of the website.

Nothing in this section prevents lawful indexing by search engines or other activity we expressly permit.

17. SUSPENSION AND TERMINATION

We may suspend or terminate your account or access to the website where we reasonably believe you have breached these Terms, engaged in fraud, or misused the website.

Termination will not affect any rights or liabilities that arose before termination.

18. LIABILITY

Nothing in these Terms excludes or limits liability where it would be unlawful to do so. This includes liability for:
a. death or personal injury caused by negligence
b. fraud or fraudulent misrepresentation
c. breach of your statutory rights as a consumer
d. any other liability that cannot be excluded or limited under applicable law

Subject to the above, we are responsible for losses you suffer that are a foreseeable result of our breach of these Terms or our negligence, but we are not responsible for losses that are not foreseeable.

We supply products through this website for domestic and private use only. We are not liable for business losses, including loss of profit, loss of business, business interruption or loss of business opportunity, where you use the products for commercial purposes.

We are not liable for delays or failures caused by events outside our reasonable control.

19. INDEMNITY

You agree to compensate us for losses we suffer as a result of your breach of these Terms, but only to the extent that such losses are reasonably foreseeable and permitted by law.

This section does not require you to indemnify us for losses caused by our own negligence, breach of contract or unlawful conduct.

20. SEVERABILITY

If any provision of these Terms is found by a court or other competent authority to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

21. NO WAIVER

If we do not enforce a provision of these Terms immediately, that does not mean we have waived our right to do so later.

22. ENTIRE AGREEMENT

These Terms, together with any policies expressly referred to in them, form the entire agreement between you and us in relation to your use of the website and your purchase of products through it.

23. TRANSFER

We may transfer our rights and obligations under these Terms to another organisation, but this will not affect your rights under the contract.

You may only transfer your rights or obligations under these Terms if we agree in writing.

24. GOVERNING LAW AND JURISDICTION

These Terms are governed by the law of England and Wales.

If you are a consumer, you may bring legal proceedings in the courts of England and Wales or, if you live in Scotland or Northern Ireland, in the courts of your home nation. If you are a consumer resident in Scotland or Northern Ireland, we may only bring proceedings against you in your home nation.

If you are not a consumer, the courts of England and Wales will have exclusive jurisdiction, unless we agree otherwise in writing.

25. CHANGES TO THESE TERMS

We may update these Terms from time to time. The latest version will always be posted on this page with the “Last updated” date.

Any changes will apply to orders placed after the updated Terms are posted.
